Upcoming FSLA Workshop Day

FSLA is organising another round of workshops at the Financial Services Authority on Monday 21 November 2011.

An afternoon of workshops running from 13.00 – 18.30 will be available to FSLA members. We have a line up covering a range of current topics including the new MiFID, European Market Infrastructure Regulations, the White Paper on UK reform and the future of financial services enforcement under the new authority.

Essay Competition 2012

FSLA is pleased to launch our 2012 essay competition. This year’s title is:

“The financial services industry is competitive enough. The Regulator does not need a duty to promote competition”.

This competition aims to provide a platform for students and trainee practitioners to express their ideas on a current topic of debate in the industry, in light of the introduction of the FCA and PRA.

Essays should be no longer than 1,500 words. For the full rules please click here.

Please submit your essay before Monday 20 February 2012 to treasurer@fsla.org.uk with ‘Essay Competition 2012’ in the subject line.

The Chris Stallard Memorial Prize (first prize) is £1,000 plus a six week internship at the FSA (two weeks with the Regulatory Decisions Committee, two weeks with the Enforcement Division, and two weeks with the General Counsel’s Division). Second prize is £500. Third prize is £250.

“The internship is of course an excellent way to gain practical experience of financial services regulation and public law issues. But there are a number of other reasons why I wouldn’t hesitate to recommend it. Such as the fact that it’s extremely flexible — before the internship began I was asked where I would most like to undertake seats, and my supervisors were happy to accommodate my particular interests when assigning work. Also this is an interesting time for financial services regulation. I would therefore highly recommend participating in this year’s FSLA Essay Competition.”

Entrants do not need to be FSLA members, although students are entitled to free FSLA membership.

The Financial Services Lawyers Association (FSLA) will be hosting a black tie charity dinner to raise funds for the Social Mobility Foundation.  The dinner will be prepared by the Michelin star-trained chefs of the nearby Michel Roux Jr restaurant at the Royal Institution of Chartered Surveyors in Parliament Square.  All profits from the dinner will be given to the Social Mobility Foundation. The after dinner speech will be given by a senior member of the Coalition Government.

FSLA and the Social Mobility Foundation

Since its establishment FSLA has had close ties with the Social Mobility Foundation. The Social Mobility Foundation exists to support high-achieving young people from low-income backgrounds gain access to the top universities and professions. FSLA has assisted in achieving this goal by organising summer internships at the offices / chambers of its corporate members and in conjunction with the judges of the Commercial Court of the High Court.

In addition to raising funds for this worthy cause the evening will provide a great opportunity for exchanging views with colleagues and clients in the financial services industry, trustees from the Social Mobility Foundation as well as with senior members of relevant public bodies.

Government Support for the Social Mobility Foundation

The Government are keen to use the opportunity to engage in a direct dialogue with key financial services/City firms about the Government’s social mobility policy, and the part firms can continue to play in promoting social mobility. Pausing there, it is crucial that, in order for this dialogue to be meaningful, attendees from the firms and their guests be key decision makers in their organisations.

Tables

The cost is £2,500 per table. There are only 9 tables in total, of 9 seats each. Each table will have a SMF trustee or senior government/regulatory lawyer sitting on it. The firm will receive the balance of the 8 seats. We expect many firms will invite guests from client organisations. We would encourage this.  Booking is on a first-come-first served basis.

The Bank Leumi judgment: client classification, “dealing as agent” and contractual estoppel

Speakers:

John Ahern partner, Addleshaw Goddard LLP

John is partner in Addleshaw Goddard’s Financial Regulation team, and acted for Bank Leumi in the recent Bank Leumi vs Wachner case. John has developed considerable expertise in the capital markets, wholesale, and private banking sectors both in private practice and as in-house counsel for eight years at Merrill Lynch. John has a deep understanding not only of the regulation of the financial markets in the UK but also has his finger on the regulatory pulse in securities markets and jurisdictions across the EU, Middle East and the Pacific Rim. He is a frequent speaker at seminars and conferences and has written a number of articles for well respected publications on regulation in the Financial Services sector.

Raymond Cox, QC, Fountain Court Chambers

Raymond Cox acted for Bank Leumi in Bank Leumi and Wachner. He is a commercial barrister specialising in banking and finance law.  He also recently appeared in RBS v Highland [2010] EWCA 809 Civ (issues in relation to CDOs); for Awal Bank in administration, in the ongoing disputes between Al-Gosaibi and Al-Sanea (fraud and breach of trust) and in ENKA v Banca Popolare [2009] EWHC 2410 (performance bonds).

Raymond has acted in matters arising from the collapse of Lehmans and the Icelandic Banks. He has experience of matters relating to securities, syndicated and securitised lending, derivatives, trading in financial instruments, insolvency, and international and domestic payment systems.  Raymond regularly acts in matters relating to FSA regulation, misselling, market abuse, money laundering and other regulation.  He is the joint editor of Law of Bank Payments (4th ed., 2010).
